Actaseguros Corretores de Seguros informs that, following the publication of Circular no. /C 423/11, the supervisory body clarifies that, with effects reported to June 1, 2022, the minimum capital of compulsory motor vehicle civil liability insurance is € 6,450,000 (€ 6,070,000, before and until that date ) per accident for bodily injury and €1,300,000 (€1,220,000, before and until that date) per accident for material damage.
Pursuant to Article 9(1) of Directive (EU) 2009/103/EC of the European Parliament and of the Council of 15 September 2009, as amended by Directive (EU) 2021/2118 of the Parliament and of the Council of 24 November 2021 on civil liability insurance resulting from the use of motor vehicles and monitoring compliance with the obligation to insure this liability, without prejudice to higher guarantee amounts possibly established by the Member States , each Member State shall require insurance to be compulsory for the following minimum amounts:
Regarding personal injury: €6,450,000 per claim, regardless of the number of people injured, or €1,300,000 per injured person;
With regard to material damage, € 1,300,000 per claim, regardless of the number of people injured.
The ASF further clarifies that insurers authorized to operate in Portugal in the “Civil liability for motorized land vehicles” branch must reflect the aforementioned update as of June 1, 2022 in the coverage of compulsory motor vehicle insurance contracts, as well as provide information payable to policyholders, either pre-contractual or during the term of the contract.
